Mahoning Valley Young Professionals (MVYP) Activity Waiver and Release of Liability

This Waiver and Release of Liability Agreement ("Agreement") is made and entered into by and between the undersigned participant ("Participant"), the Mahoning Valley Young Professionals ("MVYP"), the Youngstown Chamber of Commerce, and the Venue hosting the event (collectively referred to as "Event Sponsors").

1. Acknowledgment of Risk:  

Participant acknowledges that their participation in any and all MVYP-sponsored events, activities, and gatherings, including but not limited to social mixers, outdoor activities, networking events, and any events involving the consumption of alcohol, entails inherent risks, including physical injury, property damage, and other unforeseeable risks. Participant assumes full responsibility for all risks, both known and unknown, even if arising from the negligence of the Event Sponsors or others.

2. Release and Waiver of Liability:  

In consideration of being allowed to participate in MVYP events, Participant, on behalf of themselves, their heirs, personal representatives, or assigns, hereby releases, waives, discharges, and covenants not to sue MVYP, the Youngstown Chamber of Commerce, the Venue, and their respective officers, directors, agents, employees, contractors, affiliates, and representatives (collectively, the "Released Parties") from all liability for any and all claims, demands, causes of action, damages, losses, or expenses, including attorney's fees, that may arise from or relate in any way to Participant’s participation in any MVYP event or activity, including but not limited to personal injury, property damage, illness, accident, or death, whether caused by the negligence of the Released Parties or otherwise.

3. Indemnification:  

Participant agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from or in connection with their participation in MVYP events, including but not limited to injury, alcohol-related incidents, traffic violations, or property damage.

4. Alcohol Consumption:  

If Participant chooses to consume alcohol at an MVYP event, they acknowledge and agree that it is their sole responsibility to drink responsibly, ensure they have safe transportation, and fully understand the consequences of alcohol consumption. The Released Parties are not liable for any accidents, injuries, or legal actions resulting from the Participant’s consumption of alcohol.

5. Acknowledgment of Venue Rules and Regulations:  

Participant agrees to abide by all rules, regulations, and policies of the Venue where the MVYP event is being held. The Venue reserves the right to refuse service or entry to any Participant who violates these rules.

6. Photographic Release:  

Participant grants permission to MVYP and its representatives to take photographs or videos of them during events and activities. Participant consents to the use of such photographs or videos for promotional purposes, including social media and marketing materials, without compensation or restriction.

7. Governing Law:  

This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of laws principles. Participant agrees that any legal action or proceeding arising from this Agreement shall be brought in a court of competent jurisdiction located in Mahoning County, Ohio.

8. Acknowledgment of Understanding:  

By signing this Agreement, Participant acknowledges that they have read and fully understand the terms of this Agreement. Participant agrees to be bound by its terms, and acknowledges that they are voluntarily giving up legal rights, including the right to sue the Released Parties.
